Write Into Action has concluded facts and evidence clearly show Fargo Police Officer Jason Moszer was accidently shot and killed by North Dakota Highway Patrolmen Adam Malafa.

Cass County States Attorney Birch Burdick responded to Write Into Action’s questions and assertion that Malafa shot Moszer as “alternative facts”.
“If you wish to establish a position contrary to the facts by using “alternative facts”, that is entirely up to you,” Burdick said.
On March 25, 2016, WDAY reported,“Marcus Schumacher fatally shot a Fargo police officer and threatened to kill more before turning the gun on himself in a standoff last month, the Cass County State’s Attorney’s Office has concluded.”
Lab tests conducted on bullet fragments in the case were all inconclusive.
Neither Burdick, nor the BCI, has ever actually stated Marcus Schumacher shot Officer Moszer.

THE FACTS
On February 10, 2016 law enforcement received a report of a domestic incident at a Fargo residence that had escalated and a man, Marcus Schumacher, was shooting his gun.
North Dakota State Trooper Adam Malafa and Fargo Police Officer Jason Moszer were stationed at opposite ends of the alley that ran past the Schumacher home located at 308 9th Avenue North in Fargo.
Both officers had been instructed to keep pedestrians from entering the alley because of the dangerous situation.
The BCI Timeline states:
Malafa arrived in the alley south of the Schumacher residence at 8:36 P.M.
Moszer arrived in the alley north of the Schumacher residence at 8:43 P.M.
Cass County Sheriff’s reports state Deputy Matthew King was dispatched at 8:27 P.M. to check on Malafa (which is an odd time considering Malafa did not arrive at the scene until 8:36 P.M.)
“Fargo PD asked me to check on HP250 (Trooper Adam Malafa) due to driving down the alley where the shooter was. After speaking with HP250, it was determined that HP250 and I were approximately 30 to 40 yards south of the residence where the shooter was,” King stated. NOTE TO REMEMBER: DEPUTY KING AND TROOPER MALAFA KNEW WHERE THEY WERE AT (30 to 40 yards south of the residence).
The following, taken from the BCI timeline, is going to show you that Malafa accidently shot Moszer in the dark alley.
“9:05 P.M. - Officer JASON MOSZER exits his patrol vehicle and walks southbound through the alley toward the subject residence. Officer JASON MOSZER positions himself on the north side of a light blue garage located on the west side of the alleyway,” the BCI reports.
At 9:07 “shots fired” is heard over the radio and Moszer reports he is in the alley north of Schumacher’s residence.
“9:09 P.M. - MARCUS SCHUMACHER shoots at Trooper Malafa, who is positioned south of the subject residence near his patrol car in the alleyway near 8th Avenue North. Trooper Malafa is not injured,” the BCI reports.
“9:11 P.M. - MARCUS SCHUMACHER fired four (4) shots towards Officer JASON MOSZER. [REDACTED CONTENT BY BCI -------------------------------------------------------------------------------------------------------------------------------------------]”

“9:19 P.M. - Dispatch advises over the police radio that they have received multiple calls about an officer down in the alleyway near a light blue garage located north of the subject residence near 305 9th Avenue North,” the BCI reports.
Of course, the officer that is down by the light blue garage is Jason Moszer.
TROOPER ADAM MALAFA’S STATEMNTS TO BCI
Malafa’s statement to the BCI is defensive.
Malafa told the BCI he had not been informed of the “correct location” of the Schumacher residence. BCI reports said Malafa “believed the residence was on the corner of 3rd Street North and 9th Avenue North.”
But we already know Malafa was joined by Deputy King and they knew exactly where they were at.
3rd Street North and 9th Avenue North is located across the street from the Schumacher residence and Moszer was shot in that alley while peeking out from around a garage.
Malafa, in his own words, has placed the shooter on the other side of the street.
Whatever the reason … Malafa mistakenly believed he should be focused across the street to the North of the Schumacher home.
It was a critical mistake.
Because…
Moszer was located in the alley where Malafa misplaced his focus. And - Moszer had gotten out of his vehicle with his rifle to take up a position behind a blue garage.
Therefore – Moszer walked north down the alley in the dark with a rifle in the direction of Malafa - while bullets were flying around.
MALAFA CLAIMS HE THOUGHT SCHUMACHER MIGHT BE "ON FOOT"
Trooper Malafa told BCI agents he believed Marcus Schumacher might be “on foot” and would be approaching him.
Believing that MARCUS SCHUMACHER was either on foot or on a rooftop, Trooper Malafa fled his squad car to the south and east away from the gunshots. Trooper Malafa stated he assumed a prone position and covered his squad car. Trooper Malafa believed that if the gunman was on foot, the gunman would be approaching Trooper Malafa’s position from the area of Trooper Malafa’s squad car.

Trooper Malafa was receiving fire, and he returned fire at the person he believed was shooting at him.
Unfortunately, Trooper Malafa mistook Officer Moszer for Marcus Schumacher and accidently shot and killed him.
THE COVER UP
Write Into Action initiated an investigation into the Moszer shooting after receiving work product from Mark E. Nelson, LA Sevareid Newsgroup, Fargo that revealed evidence in the form of shell casings had been found and then mysteriously vanished.
The cover up of the truth about the Moszer shooting is far more disturbing than an accident that happened in a dark alley.
The BCI and Burdick know what really happened because shell casing were found; turned over to a BCI agent; and then hidden and/or vanished.
According to official version of the events, Jerrod Wagner, a sniper on the Red River Valley SWAT team, fired two shots at Marcus Schumacher. The shell casings for those two shots were found right next to his rifle.

That's a lie.
Additional shell casings were found that vanished.

North Dakota Highway Patrol Colonel Michael Gerhart and the North Dakota Attorney General's office were contacted for comment but no reply was received.
